Whilst we reserve the right to amend our rental prices at any time, we will confirm to the current price at the time of. As soon as you have confirmed the booking in writing, and paid your deposit or the full payment the cost of the rental is guaranteed against any further changes. This guarantee is offered subject to our terms and conditions and the required payments being adhered to and providing that there are no amendments to the original booking.
Your rental includes accommodation as booked including water, electricity, cable TV, local, National and International telephone service (see section 12 for details), Wireless Hi-Speed Internet access (see section 13 for details) and a full clean after you leave. IT DOES NOT include flights, car hire, holiday insurance and any other items not already mentioned.
Accepted forms of payment are :-
· Direct transfer into our UK bank account (preferred method)
· Personal or bankers cheque/check
· Via Paypal
· Direct Bank Transfer into our US bank account (US renters only)
If you are from the UK and book less than 3 weeks before your arrival you must pay by bank transfer. If you are from the US you can use PayPal or pay by direct bank transfer.
Bookings are not valid until:-
a) The booking form has been completed and the terms and conditions have been signed by the head of the party and received by the Owner and
b) The appropriate deposit, or total amount due, has been paid and
c) The booking has been confirmed in writing by the Owner to the Guest.
Provisional bookings will only be held as such for 4 days after an initial enquiry has indicated that a booking is likely, after which the Owner has the right to take another booking in its place.
The minimum number of nights that can be booked is four. On bookings of less than 1 week there is a £40/$70 cleaning charge.
2. Responsible Person
The person, who signs the terms and conditions certifies that he or she is authorised to agree to those conditions on behalf of all persons included on the booking form, including those substituted or added at a later date. The signatory must be a member of the party occupying the property and must be aged 21 years or older and will be liable if any breach of these conditions occur. Bookings cannot be accepted from parties of young people less than 21 years of age.
A non refundable deposit of £75/$125 per week is required to secure the booking. Once the payment is cleared the booking will be accepted and it will become a firm booking.
The balance must be paid at least 8 weeks prior to the departure date. In the case of bookings made less than 8 weeks before the departure date, the payment in full must be sent with the signed Terms & Conditions.
If payment in full is not made before the due date we reserve the right to cancel the booking and keep any deposits paid. In the event of a cheque/check not being honoured by the bank on which it is drawn we will make a charge to cover the costs of any bank charges incurred by us plus our administration costs.
At the time of full & final payment, a separate refundable (upon these Terms & Conditions being adhered to) security deposit of £150/$250 is required. Charges for damages, losses or any maintenance or repairs to the premises, equipment, amenities or fixtures, or any cleaning services over and above those normally required to prepare the villa for the next Guest which are necessitated by misuse or extraordinary uncleanliness, replacement of lost keys, will be at the discretion of our Management Company and will be deducted from the Security Deposit. This includes cleaning of the BBQ’s after use.
The Guest is solely responsible for and agrees to pay for any damage or breakages beyond “wear and tear” that may be caused to the property and/or to its contents, and also for any loss of items in the inventory during their stay. Upon arrival, the Guest should immediately report any damage to the premises to our Management Company. Examples of such damage might include, but are not limited to, broken windows or blinds, torn screen on porch, burn marks on counters or furniture, appliance problems, major stains, etc.
The Security deposit will be refunded by cheque/check, less any charges, to you within 30 days of your return and once our Management Company has walked the property and returned a satisfactory report. In the event that any damage or loss is assessed to be in excess of the amount of the Security Deposit collected, the Guest will be held responsible for full reimbursement of the outstanding amount and agrees to pay said amount within fourteen (14) days of written notification of such by the Owners.
4. Cancellation of your booking
If you wish to cancel your booking, you must contact the Owner immediately by telephone or email and must be confirmed in writing as soon as possible. Cancellations will only be accepted by the person who signed the terms and conditions. The date of the cancellation will be from the date that the letter is received.
The Owner shall be entitled to retain all payments already made (except the security deposit) and to recover, if not already paid the balance of the rental charges as follows:-
Between 4 & 8 weeks before the rental period: 60% of the total cost.
Less than 4 weeks before the rental period: 100% of the total cost.
If we can re-book the cancelled dates any monies paid, less the deposit and any other deductions incurred, will be refunded.
5. Alterations to confirmed bookings
All requests to alter a confirmed booking must be made by the lead guest in writing and must be confirmed by the owners in writing. Whilst the owners will try to accommodate any request to alter a confirmed booking (subject to availability) we make no guarantee that any alteration will be possible. If an alteration is not possible and the guest decides to cancel the normal cancellation charges will apply.
If any alterations/amendments are made to a confirmed booking, this may result in the price guarantee becoming void and the booking becoming subject to the prices in force at the time of the alteration.
If the alteration is made to a confirmed booking which results in the number of nights/length of stay being reduced, then a pro-rata refund maybe paid at the owners discretion. If the number of nights/length of stay is increased then the relevant daily rates will apply.
6. Complaints or Problems
In the unlikely event that you should have a problem with our rental home or its facilities, please bring this to the attention of our Management Company immediately so they can investigate and attempt to resolve the issue locally. If you are still dissatisfied with the outcome, please send the complaint in writing to our management company within 14 days of your return home and send us a copy.
If you do not bring your complaint to our management company’s attention immediately, you will have not allowed them the opportunity to satisfactorily resolve your problem – in these circumstances, we will be unable to assist with your complaint – we cannot try to put things right for you when you have returned home!
Please note, however, that we cannot accept responsibility for the actions or omissions of our management company staff or the staff on the complex.
7. Force Majeure
Although every effort is made to ensure that our villa is in superior condition, neither the Owners, our Management Company, nor their agents, shall be held responsible for any third party claims, accidents, damage to or loss of property, or for any expenses incurred for any reason, including changes caused by Force Majeure, regardless of how they may have occurred.
No liability is accepted by the Owner for the loss of main services or failure of appliances, nor for the consequences of the actions or omissions of persons who may control supply of mains service, nor any actions taken in the vicinity of the property by any authority over which there is no control by the owner.
The owner or our agents will also not be liable for any loss or delay occasioned by any of, but not limited to, the following: strikes, riots, political unrest, war or threat of war, terrorist activities, industrial disputes, fire, flood, technical or weather problems to transport, aircraft, closure of airports, or any other event beyond the Owners control.
If circumstances arise beyond our control the right is reserved to cancel your booking. In this case we will attempt to find you alternative accommodation on the same complex (if agreeable with the Guest), or, without liability, refund all monies paid to us. The Owner cannot guarantee that all the facilities described on the website and/or brochure will be available.
You are strongly advised to take out adequate travel/holiday insurance at the time of making your booking and that the insurance lasts for the duration of your trip. Please insure that the insurance cover includes (as a minimum) cancellation and medical cover. The Guest uses the property at their own risk, and the owners will not accept responsibility for any injury, loss or damage whilst using the property. This waiver also applies to people visiting our property as guests of the Guest.
9. Smoking and Pets
Smoking is not allowed in the house, smoking in the screened porch is permissible. This rental property is designated as a “No Smoking” property, and all Guests agree to refrain from smoking inside the house. Contravention of this condition will render your booking void, all monies paid will be forfeited and you will be asked to leave the property without compensation.
In the event that neutralization of smoke odours from cigarettes, cigars, pipes or other smoking materials is required, or in the event that burn marks from cigarettes, cigars, pipes, or other smoking materials are detected, the cost for elimination of those odours or repair of the burn marks will be levied against the Guest, this will be in addition to the Security Deposit.
For the comfort of ALL renters NO PETS are allowed. Contravention of this condition will render your booking void, all monies paid will be forfeited and you will be asked to leave the property without compensation. In the event that neutralization of animal smells is required, or in the event that marks or any damage caused by animals are detected, the cost for elimination of those odours or repairs will be levied against the Guest, this will be in addition to the Security Deposit.
10. Check in and out times
Our property is available after 4pm on the day of arrival and must be vacated by 10am on the day of departure. Failure to comply with this may result in an extra day’s rental charge being incurred which the Guest agrees to pay.
The maximum occupancy for our property is 6 persons, this is determined by the authorities within strict guidelines for fire safety. The only exception to this is when and if a cot (for one child only) is situated in the Master bedroom. Only those persons listed on the booking form are authorised to stay in our property, changes must be made in writing to the owner and confirmed by them before occupancy commences. Contravention of this condition will render your booking void, all monies paid will be forfeited and you will be asked to leave the property without compensation.
12. FREE phone calls
We offer FREE phone calls up to a weekly limit. Calls to anywhere in the USA & Canada are free and can be made directly from the phone. All other calls are offered in good faith for contacting relatives and loved ones and we do not expect it to be abused. The limits are as follows:
Calls to UK landlines – 200 mins per week
Calls to UK mobiles – 25 mins per week
Calls to Europe landlines – 160 mins per week
Calls to Europe mobiles – 20 mins per week
We check the usage online and if we feel that this facility has been abused we will deduct the difference from your Security deposit.
You MUST use the procedure outlined in our information book to make use of this facility. The cost of calls made not using this facility will be deducted from your security deposit.
13. Wireless Internet Access
Hi-Speed Broadband Internet connection is provided FREE for guests use only. The owner will use their best endeavours to ensure that the service is available for use, but cannot be held responsible for any failures, or non-availability, of communication lines, hardware or software. Signing of our booking form is a contract between your party and us and within the terms of this contract you agree not to download or save any pornographic, offensive, obscene or illegal material.”
Vista Del Lago is a quiet residential gated community which is made up of mainly US residential families. It is a condition of your rental that your behaviour and noise levels do not breach the strict community rules that are in place.
